Terms of Service

1. Agreement
By creating an account or using Backbend (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Backbend is a platform for building and running personal AI agents. You configure agents that perform tasks on your behalf using third-party model providers (Anthropic, OpenAI, Google, xAI) and tools you authorize.
3. Accounts
You are responsible for maintaining the security of the credentials you use to sign in (GitHub, Google) and for any activity under your account. Notify us promptly if you suspect unauthorized access.
4. Your content and credentials
You retain ownership of prompts, files, and data you upload (“Your Content”). You grant Backbend a limited license to store, transmit, and process Your Content solely to operate the Service for you. API keys, OAuth tokens, and other credentials you connect are encrypted at rest using a per-deployment secret key.
5. Acceptable use
You agree not to use Backbend to:
- break the law or facilitate someone else doing so;
- send spam, malware, or unsolicited bulk communication;
- infringe intellectual property or privacy rights;
- harass, threaten, or harm others;
- circumvent rate limits or anti-abuse measures of any third-party service;
- generate content depicting child sexual abuse material, or content that incites violence;
- reverse-engineer, scrape, or resell the Service.
6. Third-party services
Backbend integrates with external providers (model APIs, Google APIs, GitHub, browser automation runtimes, SMS via Linq). Those services have their own terms; you are responsible for complying with them when you connect them. We are not responsible for their availability or actions.
7. Fees and billing
Where Backbend charges fees, those will be disclosed at the point of purchase. Model-provider usage is billed by the providers through the API keys you supply, Backbend does not mark up or rebill that usage.
8. Privacy
We collect only what's needed to operate the Service. We do not sell your data. Specifics on what is stored, where, and for how long are described in our Privacy Policy (forthcoming).
9. Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.
10. Disclaimers
The Service is provided “as is” without warranties of any kind. AI agents can make mistakes; outputs may be inaccurate, incomplete, or unsafe. Review actions taken by agents that have real-world consequences (sending messages, making purchases, modifying files) before relying on them.
11. Limitation of liability
To the maximum extent permitted by law, Backbend's total liability arising out of or relating to the Service shall not exceed the greater of (a) fees you paid Backbend in the three months preceding the claim or (b) USD $100. Backbend is not liable for indirect, incidental, special, consequential, or punitive damages.
12. Changes
We may update these Terms. Material changes will be flagged on the login page or by email. Continued use after a change takes effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Utah County, Utah.
